I’ve written separately about when Kansas vehicle title transfers specifically need a notary. A related but distinct question comes up just as often: what about the bill of sale itself, for a car, boat, trailer, or other significant piece of personal property?
Is it legally required?
For most private-party sales, a bill of sale doesn’t have to be notarized to be valid — a signed, dated document describing the item and the agreed price is generally sufficient on its own. Where notarization becomes relevant is usually about proof, not legal requirement.
Why sellers and buyers notarize one anyway
- Higher-value items — a notarized bill of sale is harder to dispute later than an unwitnessed signature, which matters more as the dollar amount goes up
- Out-of-state buyers — some other states’ DMVs or registration agencies require a notarized bill of sale even when Kansas or Missouri wouldn’t
- Boats and trailers with separate title requirements, where the notarization requirement can differ from vehicle rules
- Disputes down the road — if a sale is ever questioned (an unpaid loan tied to the item, a dispute over condition or mileage at time of sale), a notarized bill of sale is stronger evidence of exactly what was agreed and when
A notarized bill of sale doesn’t change what you agreed to — it just makes it much harder for anyone to credibly claim later that the agreement was different.
What to bring
Both buyer and seller present, valid ID for each, and the bill of sale itself with the key details already filled in — item description, VIN or serial number if applicable, sale price, and date. I’m verifying identity and willingness, not the accuracy of the item’s description, so having those details correct before the appointment keeps things quick.
